MyConsumerIntel.co.uk Membership - Terms, Conditions, Privacy Policy


General

1.1. This section states the Terms and Conditions under which you may use the www.MyConsumerIntel.co.uk, domain belonging to Consumer Intelligence Ltd., whose place of business is at 23-35 Canard Court, St Georges Road, Bristol, BS1 5UU. Our company registered number is 4954720.
1.2. Use of the Website, membership of the panel set up and administered by Consumer Intelligence and participation in any other Consumer Intelligence research activities is governed by these terms and conditions of use. If you do not accept the Terms and Conditions stated here, do not use this website and its services.

2. Acknowledgement and Acceptance

2.1. By clicking “Click to Join” during the process of registration as a Consumer Intelligence member, and by participating in any Consumer Intelligence activity, you agree to be bound by these terms.
2.2. Consumer Intelligence reserves the right at any time to modify or amend these terms and conditions without notice to you. Membership and participation in Consumer Intelligence activities is subject to you acknowledging any modification and agreeing to be bound by the modified terms.

3. Terms of Registration

3.1. To become a member of the Consumer Intelligence panel, you must register and create a Membership Profile following the registration process set out on the site.
3.2. Information provided during the registration process must be true, accurate, current and complete.
3.3. Membership details must be maintained and updated so as to keep them true, accurate, current and complete.
3.4. If you provide any information that is untrue, inaccurate, not current or incomplete – or if Consumer Intelligence believes this to be the case – Consumer Intelligence reserves the right to suspend your account until such details have been thoroughly checked.
3.5. Only one panel membership profile is permitted per person. Any member found to have multiple panel membership profiles may have any or all of those profiles suspended. Consumer Intelligence may require proof of identity in the case of any dispute.
3.6. Each member must use a unique email address to register with the panel, and must provide full name and address information. This is in order that we can confirm member identity and process payment.

4. Payment

4.1. Payment for any activity conducted as a member of the Consumer Intelligence panel is made online via PayPal.
4.2. Payments for surveys, mystery shopping projects and competitions are normally made within one week of the specified closing date. Member referral payments are dealt with separately.
4.3. Payments will only be earned through following all and any instructions regarding the project in question. A member’s failure to correctly follow any required instructions or procedures may result in no payment being processed, for which the member will have no recourse against Consumer Intelligence.
4.4. Members should be aware that any payments derived from activities involving Consumer Intelligence may be subject to income tax and that members should make the necessary declarations to HMRC.
4.5. Consumer Intelligence reserves the right to change the range of activities through which payments can be accrued and to vary the frequency of invitation and level of payment for such activities.

5. Competitions and Prize Draws

5.1. Competitions and prize draws will have their own terms and conditions that will apply, and these will be made available at the time of notification.
5.2. By taking part in prize draws and competitions offered by Consumer Intelligence, participants agree that their first name and location may be published on the Community website should a prize be won.

6. Referrals (“Refer a Friend” or RAF scheme)

6.1. Registration with the MyConsumerIntel.co.uk panel will provide you with a referral link via which you are able to recommend to friends that they may also join the panel.
6.2. For each new member that signs up via your referral link, you will receive £1 - when that new member completes their first full survey.
6.3. For each new member that signs up through a member that you referred, you will receive an additional 10p – when such new members complete their first full survey.
6.4. Payment for referrals will be made online by via PayPal when those referred members details have been duly checked and signed off as correct and authentic and completed their first full survey.
6.5. As the name of the scheme indicates, it is to reward the introduction of friends, relatives, and colleagues to MyConsumerIntel.co.uk. You must not mislead or deceive prospective new members, third party web sites or MyConsumerIntel.co.uk.
6.6. Any suspicious referrals will be investigated by Consumer Intelligence and may result in account termination and loss of any accrued earnings or cash prizes.

7. Completion of Surveys and Mystery Shopping Projects

7.1. Members will be notified by email of any surveys or mystery shopping projects for which they are eligible.
7.2. Members are under no obligation to complete the projects to which they are invited, but if participation is accepted, projects must be completed by the specified deadline.
7.3. If projects are not completed within the specified timeframe, the work will not be accepted and payment will not be made.
7.4. Members agree that they will undertake any projects to which they agree both sincerely and objectively.
7.5. Consumer Intelligence shall regularly check members’ responses to surveys and mystery shopping projects, in order to ensure their validity and quality. As a result, in the event of inaccurate or incoherent responses, or other suspect information, Consumer Intelligence will apply a “two strikes” rule.
7.6. The “two strikes” rule states that for one offence, members will receive no payment for the project in question. For the second offence, members will receive no payment and be removed from the Consumer Intelligence panel.
7.7. Offences covered by the “two strikes” rule comprise: straight-lining (selecting the same response in grid questions multiple times), speeding (completing a project at an unrealistic speed), answering inconsistently, miss-selection of dummy answers, poor-quality responses to open-ended questions, and re-tries.  The latter refers to the practice of attempting to complete the same survey twice with different answers.

8. Termination

8.1. If you no longer wish to be a member, you can notify Consumer Intelligence by replying to any email or by using the Contact form on the http://www.myconsumerintel.co.uk website. Consumer Intelligence will then cease to contact you, subject to a 30 day administration period. In terminating membership, any accumulated earnings below the required payment threshold will be forfeited.
8.2. Members agree that Consumer Intelligence may suspend or terminate your membership should any of these Terms and Conditions be breached.
8.3. Consumer Intelligence reserves the right to terminate the Consumer Intelligence panel or http://www.myconsumerintel.co.uk website at any time. In such a case, any accumulated earnings below the required payment threshold will be non-redeemable. Consumer Intelligence will endeavour to notify all members of the termination period, however, Consumer Intelligence will not be liable for failure to notify any member regardless of reasons.

9. Website

9.1. The contents of this website and of all other websites under Consumer Intelligence's control such as text, graphics, images, logos, button icons, software and other website content are protected under copyright laws.
9.2. All website Content is the property of Consumer Intelligence or its content suppliers. You may not sell or modify the website Content or reproduce, display, publicly perform, distribute or otherwise use the website Content in any way for any public or commercial purpose. The use of the website Content on any other website or in a networked computer environment for any purpose is prohibited.
9.3. Users may not use the website in order to display, transmit, distribute, store or destroy material including, without limitation, website Content, (a) in violation of any applicable law or regulation, or (b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy, publicity or other personal rights of others.
9.4. This Site is intended solely for users who are eighteen (18) years of age or older.
9.5. Users are prohibited from violating or attempting to violate the security of any Consumer Intelligence Site including, accessing data not intended for such user or logging into a server or account which the user is not authorised to access, attempting to probe or test the vulnerability of a system or network or to breach security or authentication measures without proper authorisation, attempting to interfere with service to any user, host or network including, without limitation, via means of submitting a virus to any Consumer Intelligence Site, overloading or forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting. Violations of system or network security may result in civil or criminal liability.
9.6. My Consumer Intelligence may be used only for lawful purposes by individuals willing to participate in Mystery Shopping projects run by Consumer Intelligence.

10. Data Protection

Legal Entity and Data Controller is Consumer Intelligence Limited.


Consumer Intelligence takes your privacy seriously and takes every reasonable precaution to safeguard the personal information you supply to it.  Consumer Intelligence is registered under the Data Protection Act 1998 under registration number Z8560778. The information you provide is safeguarded under the terms of that Act. As part of the registration process of Consumer Intelligence you will be asked to provide certain personal profile information, this information is not made available to any organisations for marketing purposes.  Consumer Intelligence only use this information to confirm your suitability for the audience sample required for specific surveys.


You warrant that the information you provide is accurate and truthful. The data you provide to Consumer Intelligence will be held as you have provided it. You may at any time amend or update your data by visiting Consumer Intelligence at www.myconsumerintel.co.uk or contacting us.

11. Use of Cookies


Consumer Intelligence does not use resident cookies to collect or store data on your hard disk, but does use session variables to store data in your browser, which ensures sufficient functionality of our site. A session variable is a temporary cookie stored in your browser memory that expires when you close your browser. Consumer Intelligence tracks visitors to and on the Consumer Intelligence site by using referrer tracking. Consumer Intelligence uses click thru and open mail tracking when sending emails. This process allows Consumer Intelligence the ability to profile and analyse the recipients of their communications.

12. Information we collect and Uses of that Information


We do not collect personal information when you visit our site unless you register.  The information gathered at the time of registration (such as your email address, postal code, age and income level etc) is used to determine your suitability for mystery shopping projects and online surveys.  Your contact details are only used to appraise you of assignments available.  You may choose not to receive future mailings. When you submit feedback or questions via email, or contact us for information about our Web site, we will request your name and email address. We use this information solely to respond to your inquiries. We do not sell, rent, or otherwise disclose your personal information to any third parties, and we do not use your mailing address information for unsolicited marketing.

13. Use of Your Data for Analytical and Statistical Purposes


Your data together with that of other members to Consumer Intelligence may be aggregated at Postcode or other levels for the building of statistical and analytical tables. At no time will your data be individually identifiable in such tables.

14. Legal Requirements to Provide Data


Consumer Intelligence will not provide your personal information to any third party without your prior consent; however, under certain circumstances the force of law may require the provision of information to the legal authorities. In order to maintain the integrity of its website and safeguard the interests of its subscribers Consumer Intelligence will comply with any such legally binding request.


15. Security of The Internet


The Internet is not a 100% secure medium for communication and, as such, Consumer Intelligence cannot guarantee the security of any information you send to Consumer Intelligence via the Internet. Consumer Intelligence is not responsible for any loss or damage you or others may suffer as a result of the loss of confidentiality of such information.


16. Use of External Suppliers


Consumer Intelligence may from time to time use third party suppliers or partner with approved organisations to provide all or part of a service to you. Consumer Intelligence shall only be entitled to supply such of your personal information as is necessary to enable them to provide the relevant service to you. You should be aware that such outside service providers might be based in countries outside the European Union whose laws provide for a different standard of protection for your personal data than that provided under English law. In such circumstance Consumer Intelligence will have in place contractual arrangements which will require your data to be processed at least to a standard compliant with the Data Protection Act 1998.
